HAIKI Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.HAIKI.com (the “Site”).

By accessing or using this website, mobile application or other HAIKI product or service (collectively, "Services") on any computer, mobile phone, tablet, console or other device (collectively, "Device"), you consent to our Privacy Policy. We may modify this Privacy Policy at any time effective upon its posting. Your continued use of our Services constitutes your acceptance of this Privacy Policy and any updates to it. This Privacy Policy is incorporated into, and is subject to, the Terms of Use.

The Privacy Policy does not apply to third party websites ("Third Party Services"), such as, Instagram and Google+, that we do not own or control, even if you access them through our website.

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, address, billing address, shipping address, ZIP code, phone number, fax number, email address, photos, videos, social media usernames, payment information (including credit card numbers), demographic information, information about your interests and preferences, information about your fitness condition and physical characteristics, and any other information you choose to provide.  We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

We are based in the United States and the information we collect is governed by U.S. law.  By accessing or using our Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries.

Your Information

You may update or correct your online account information by logging into your online account and updating your information or by calling at Customer Service at 1 877-55-HAIKI (1 877-554-2454). You may also email us at info@haiki.com if you wish to deactivate your online account, but note that we may retain information about you for legitimate business purposes or as required by law.  

Promotional Communications

You may opt out of receiving promotional communications by following the instructions in those communications or changing your preferences by contacting customer service at info@HAIKI.com. If you opt out of receiving promotional communications, we may still send you non-promotional emails, such as emails about your purchases, account, or our ongoing business relations.

 

Location Information

 

The settings of your Internet browser or mobile device may allow you to stop sharing your precise location. You can also stop our collection of location information in connection with our mobile applications by following the standard uninstall process and removing all HAIKI applications from your mobile device.

Mobile Push Notifications/Alerts

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device.  You can deactivate these messages at any time by changing the notification settings on your mobile device.

Third Party Advertising, Analytics and Services

We allow third parties to serve advertisements that are targeted to your interests and we engage third parties to provide analytics services. These third parties may use cookies, web beacons, and other technologies to collect information about your use of the Services and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information. In some cases, the information in these cookies and other technologies may be linked to data you

voluntarily submitted to us, such as your email address, which we may share in hashed or encrypted form. This information may be used by us and these third parties to analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites and mobile applications, and better understand your online activity.

We may also work with third parties to serve ads to you as part of a customized campaign on third-party platforms (such as Instagram or Google). Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

We also use a third party to "power" product reviews and product questions and answers on our Services. When you submit a product review, you may become subject to the terms of use and privacy policy of this third party and the reviews you submit may be posted on our Services and on third-party sites.

Children's Information

We do not knowingly collect information from children under the age of 13, in accordance with the Children's Online Privacy Protection Act ("COPPA"). Furthermore, we do not knowingly allow children under the age of 18 to use the Services or to set up an Account with us.

Most of the information we collect is gathered when you search, buy, post, participate in surveys or otherwise communicate with us. If you use our Services to make a purchase, we may request certain Personal Information from you to facilitate the transaction. You may also provide us with Personal Information when you use certain Services, such as subscribing filling our "Stay in Touch" form or signing up to the Services as a user or guest.

Our Services may incorporate technology such as "pixel tags,"; "web beacons," and "cookies" that allow us to track the actions of users of our Services. Pixel tags or web beacons are tracking devices on websites or in e-mails that can monitor the behavior of the user visiting the website or sending the e-mail. Cookies are small files that web servers may place on your computer when you visit a website.

How Do We Use Your Personal Information?

We primarily use the information we collect and store to enhance, customize and personalize the Services and your experiences with HAIKI. Ways we may use this information include, but is not limited to, the following:

How We Protect Personal Information

We use a variety of security measures, including encryption and authentication tools, to help protect your information. We use secure servers when you place orders. All credit card information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted within our databases.

To the fullest extent permitted by applicable law, in no event shall the aggregate liability of HAIKI), whether in contract, warranty, tort (including negligence, whether active, passive or imputed), or other theory, arising out of or relating to the use of or inability to use the complete site exceed any compensation you pay, if any, to HAIKI for access to or use of the complete site. The limitations set forth in this section 15 will not limit or exclude the HAIKI’s liability for gross negligence, fraud, intentional, willful, malicious or reckless misconduct.

Except as expressly provided, the Site, Site Content, User Content and services provided on or in connection with the Site are provided on an "AS IS" and "WITH ALL FAULTS" basis without representations, warranties or conditions of any kind, either express or implied. HAIKI DISCLAIMS ALL OTHER REPRESENTATIONS, WARRANTIES, CONDITIONS AND DUTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES, DUTIES OR CONDITIONS: (A) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, RESULTS, TITLE, AND NON-INFRINGEMENT; AND (B) CREATED BY TRADE USAGE, COURSE OF DEALING OR COURSE OF PERFORMANCE.
